Article 1 (Grant of Right)

1. This Terms of Service (hereinafter, called "TERMS OF SERVICE") is an agreement made by Patent Integration Co. Ltd. (hereinafter called "PI") to determine use conditions between PI and the user using an software service(hereinafter called "SERVICE").
2. PI, subject to the provisions of this TERMS OF SERVICE, hereby grants the user a non-sublicensable and nonexclusive right to install this SERVICE into a personal computer and use the SERVICE.
3. By downloading or using this SERVICE, the user is granted to agree to be bound by all the provisions of this TERMS OF SERVICE. The user is not allowed to download or use this SERVICE without agreeing the provisions of this TERMS OR SERVICE.

Article 2 (Notice for Use)

PI may update this SERVICE without the user's consent. PI is not responsible for any damages arising out of the update and incurred by the user. This TERMS OF SERVICE is also applied to the updated version of this SERVICE.

Article 3 (Collection and Usage purpose of Personal Data)

PI shall manage personal information obtained from the user according to the privacy policy of PI, unless otherwise provided.

Article 4 (Prohibited Acts)

The user is prohibited to perform acts as herein provided and other acts likely to perform the acts when using this SERVICE.

1. To damage life, body, property, the good name, reputation, privacy and so on of PI or a third party
2. Criminal acts
3. Sabotage for a server operated and managed by PI
4. To make an impact on a service or a network system operated by PI
5. To technically analyze or modify this SERVICE
6. To copy or distribute this SERVICE
7. To assign or lease this SERVICE
8. To infringe upon the law or socially acceptable behavior
9. Any other acts deemed to be unsuitable for PI

Article 5 (Termination)

1. PI may terminate the use of this SERVICE by the user when PI deems that the user is not suitable to use this SERVICE.
2. PI does not take any responsibilities for any damages incurred by the user due to any acts defined in the preceding paragraph.

Article 6 (No Warranties)

PI provides this SERVICE "as is" basis without warranty of the contents, performance, and safety of this SERVICE. PI does not take any responsibilities for any risks or loss arising by using of this SERVICE caused by the user.

Article 7 (Indemnity)

1. The user shall use this SERVICE on his/her responsibility and PI is not responsible for any damages arising out of the use of this SERVICE and incurred by the user.
2. PI is not responsible for any damages or loss arising out of the inability to use this SERVICE.
3. In the event of a dispute with a third party arising out of the use of this SERVICE by the user, the user shall solve the dispute at his/her own expense and responsibility and PI does not take any responsibilities.
4. In one of the events specified below, PI may suspend the provision of this SERVICE without giving notice to the user. PI does not take any responsibilities for any damages arising out of the suspension and incurred by the user.
1. If a server or a system relating to this SERVICE undergoes maintenance, inspection, or failure.
2. If natural disasters, communication line failure or other unavoidable circumstances occur.
3. Under any other circumstances in which PI deems a suspension of the provision of this SERVICE are required.

Article 8 (Ownership)

Intellectual property rights such as copyrights and any other rights relating to this SERVICE shall belong to PI or the original owner and the user shall not use a trademark, logo, or service name of PI without the prior consent of PI.

Article 9 (Compensation for Damages)

If the user breaches the TERMS OF SERVICE or makes any illegal or improper acts by using this SERVICE, PI may terminate the use of this SERVICE and may claim compensation for any damages incurred by the user. PI may claim compensation for any kind of damages, including direct and general damages, as well as lost earnings, loss of business opportunities, loss of data, business interruption, and other indirect, consequential and incidental damages.

Article 10 (Amendment of this TERMS OF SERVICE)

1. PI may amend all or a portion of this TERMS OF SERVICE without giving any advance notice to the user.
2. In the case of amendment of this TERMS OF SERVICE, the user is granted to agree the amendment by using this SERVICE after PI displays the amended TERMS OF SERVICE on this site unless otherwise provided.

Article 11 (Governing Law and Jurisdiction)

1. This TERMS OF SERVICE shall be construed and applied in accordance with the laws of Japan.
2. The Japanese version of this TERMS OF SERVICE shall be deemed as the original and the other language versions are the translated versions. The user agrees that only the original is legally binding.
3. In the event of a dispute relating to this TERMS OF SERVICE, the exclusive jurisdiction court of first instance shall be the Tokyo District Court or Tokyo Summary Court depending on the jurisdictional amount.
